Terms and Conditions

1. Introduction and Acceptance

These Terms and Conditions ("Terms") govern your use of tutoring services provided by Rex Tutors, the trading name of Caleb Akhtar Martinez ("we," "our," or "us"), a sole trader based in the United Kingdom.

By booking our services, accessing our website, or engaging with our tutors, you ("you," "your," or "Client") agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Services Provided

2.1 Tutoring by Rex Tutors (Caleb Akhtar Martinez)

We provide online tutoring services including:

• One-to-one tutoring in STEM subjects (Mathematics, Physics, Engineering)
• Oxbridge admissions preparation and academic consulting
• GCSE and A-Level tutoring support
• Personalized learning roadmaps and progress tracking
• Past paper analysis and feedback (subject to availability)

Service Components

Our tutoring service can be broken up as follows:

• Preparation: Begins 48 hours before the scheduled session, including curriculum review, personalized material preparation, and session planning tailored to your specific learning objectives
• Teaching: The scheduled session where concepts are taught, questions are answered, and interactive learning takes place

Cancellation Rights During Service Performance

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel this contract within 14 days of booking without giving any reason. However, by booking a session within 14 days, you are making an express request for our tutoring service (including preparation) to begin during this 14-day cancellation period.

You will lose your right to receive a full refund once our lesson preparation service begins (at latest 48 hours before your scheduled session). After preparation begins, you will only be charged proportionally for preparation work completed.

2.2 Referral to Independent Tutors

In addition to personal tutoring services, we may occasionally refer clients to other independent tutors ("Affiliate Tutors") to fill specific skill gaps or subject areas outside our expertise.

When we provide a referral, you are solely responsible for:

• Evaluating the suitability and qualifications of the Affiliate Tutor
• Negotiating terms, rates, and conditions directly with the Affiliate Tutor
• Arranging payment and session scheduling with the Affiliate Tutor
• Addressing any issues or disputes that may arise with the Affiliate Tutor

2.3 Session Format (Only for Rex Tutors Tutoring Service)

• All sessions are conducted online via Google Meet
• Standard session length is 1.5 hours
• Sessions are conducted in English (other languages may be available upon request)

3. Pricing and Payment

3.1 Rates

• Tutoring is priced at £100 per hour across all levels and subjects
• Minimum session length is 1.5 hours (£150 per session)
• Prices are inclusive of all taxes where applicable
• Discounts may be available for long-term commitments or students from low-income backgrounds

Long-term Agreements: Where long-term commitments or special discount arrangements are offered, these may be subject to additional or modified terms of service. Such terms will be provided to you in writing before payment is required and will supplement or, where specified, supersede the relevant provisions of these Terms.

3.2 Payment Terms

• Payment is required in advance of sessions
• We accept payments through our secure booking system (Cal.com/Stripe)
• Refunds are processed according to our cancellation policy (Section 4)
• Refunds may take up to 14 business days to appear in your account
• All payments are in British Pounds Sterling (GBP)

4. Booking and Cancellation Policy (Only for Rex Tutors Tutoring Service)

4.1 Booking Requirements

• Sessions must be booked in advance through our booking system
• You must provide accurate contact information and session requirements
• Booking confirmation will be sent via email

4.2 Cancellation Policy

• 24+ hours notice: Free rescheduling or full refund
• Less than 24 hours notice: Session will be charged in full, except in genuine emergencies at our discretion
• Emergency cancellations (less than 24 hours notice): Will be considered on a case-by-case basis with appropriate documentation
• No-show: Session will be charged in full, except in genuine emergencies at our discretion. A no-show is defined as being 10 minutes late without notice or 15 minutes late even with notice

4.3 Our Cancellation Rights

We reserve the right to cancel sessions due to illness, technical issues, or other circumstances beyond our control. In such cases, we will offer a full refund or free rescheduling.

We also reserve the right to cancel sessions or terminate services for breach of our code of conduct (Section 9). See Section 4.4 below for refund policies following termination.

4.4 Refunds Following Service Termination

If we terminate services due to breach of conduct, refunds for unused sessions will be handled as follows:

• Sessions 24+ hours away: Full refund will be provided
• Sessions less than 24 hours away: No refund will be provided

4.5 Statutory Rights (UK and EU Customers)

Your Legal Rights Are Not Affected: Nothing in these Terms affects your statutory rights as a consumer. For customers in the UK, your rights under the Consumer Rights Act 2015 and Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 remain fully in force. For customers in EU member states, your rights under the Consumer Rights Directive and other applicable consumer protection legislation are preserved.

You have a statutory 14-day cooling-off period for online bookings. For tutoring sessions, if you cancel after lesson preparation begins (defined as 48 hours before the scheduled session), you remain entitled to cancel, but refunds will be proportional to the unused portion of the service. The right to cancel ends either when the session is fully delivered or when the cooling-off period expires, whichever occurs first. By booking, you acknowledge that lesson preparation begins 48 hours in advance, which constitutes the start of the service. By booking before the end of the statuory 14 day cooling-off period, you are expressly requesting that we begin the service during this period.

4.6 Excessive Cancellations Policy

To ensure fair access to our limited tutoring slots for all clients, we reserve the right to review and potentially terminate services for clients who demonstrate a pattern of excessive cancellations, particularly those made close to the scheduled session time. Such patterns disrupt our ability to serve other clients and may result in termination of service at our sole discretion.

5. Technical Requirements and Responsibilities (Only for Rex Tutors Tutoring Service)

5.1 Client Requirements

You must provide:

• Stable internet connection suitable for video conferencing
• Computer or tablet with camera, microphone, and ability to use online whiteboard tools interactively
• Access to Google Meet (free Google account required)
• Quiet, distraction-free environment for optimal learning

5.2 Technical Support

While we will assist with basic technical issues, we are not responsible for problems arising from your internet connection, hardware, or software. Sessions lost due to client technical issues may still be charged.

6. Intellectual Property and Session Materials

6.1 Educational Materials

• Materials created by the client during sessions belong to the client
• Materials provided or created by us remain our property and may not be redistributed, but may be kept by the student for their own study
• We retain the right to use teaching methods and general approaches
• Third-party materials (textbooks, past papers) remain property of their respective owners

6.2 Session Recording

Session recording is not allowed under any circumstances. This prohibition applies to all forms of recording including but not limited to:

• Screen recording or screenshots
• Audio recording of any kind
• Video recording of sessions
• Images showing the tutor (including screenshots, photos, or any visual capture of the tutor)

Exception: Students may keep whiteboard material created during sessions for their personal study, but may not redistribute, share, or publish this content without our explicit consent.

We do not record sessions ourselves. Any unauthorized recording by clients may result in immediate termination of services and potential legal proceedings.

7. Privacy and Data Protection

Your personal data is processed in accordance with our Privacy Policy, which forms part of these Terms. We are committed to protecting your privacy and complying with UK GDPR and Data Protection Act 2018.

7.1 Session Content

• Session notes and progress records may be kept for educational continuity
• We do not share personal information with third parties except as required by law
• Digital whiteboard content is automatically deleted after sessions unless saved by agreement

8. What We're Responsible For

8.1 Our Commitment to You

We are committed to providing high-quality tutoring services and will:

• Deliver sessions with reasonable care and skill
• Provide qualified, experienced tutoring
• Honor our cancellation and refund policies
• Treat you and your family with respect and professionalism

8.2 What We Cannot Guarantee

While we work hard to help every student succeed, please understand that:

• We cannot guarantee specific exam grades or academic results
• Educational progress depends on many factors including student effort, school support, and individual circumstances
• Our tutoring supplements but does not replace your regular education
• Technical issues (internet problems, software glitches) may occasionally affect sessions
• We cannot guarantee the accuracy of every claim or statement (written or verbal) made in relation to the taught content or academic consulting, but we will try our hardest to ensure that they are accurate

8.3 Financial Limits

Our total liability for any claim arising out of these Terms shall not exceed the total fees paid by you in the 12 months preceding the claim.

8.4 Events Beyond Our Control

We shall not be liable for failure or delay in performing our obligations if such failure results from events beyond our reasonable control (including but not limited to power outages, internet failures, natural disasters, strikes, or government restrictions).

8.5 What This Doesn't Affect

These limitations don't affect your statutory consumer rights or our responsibility for:

• Death or personal injury caused by our negligence
• Fraud or deliberate misrepresentation
• Any other liability that cannot legally be limited

8.6 DBS Checks and Liability Disclaimer

Personal Tutoring Services

Referral Services

While we carefully consider our referrals based on reported qualifications and experience, it is your responsibility to conduct your own due diligence and assess whether any referred tutor meets your specific requirements, including safeguarding needs. We recommend discussing any concerns with us before proceeding with a referral, but the final decision and all associated risks remain with you.

9. Acceptable Use and Conduct

9.1 Client Responsibilities

You agree to:

• Provide accurate information when booking services
• Treat tutors with respect and courtesy
• Attend sessions punctually and prepared
• Not share session access details with unauthorized persons
• Comply with all applicable laws and regulations

9.2 Prohibited Conduct

The following conduct is strictly prohibited:

• Harassment, discrimination, or inappropriate behavior toward tutors
• Recording sessions in any form (see Section 6.2)
• Sharing proprietary teaching materials without permission
• Using services for any unlawful purposes
• Attempting to circumvent our booking and payment systems

9.3 Termination Rights

We reserve the right to suspend or terminate services immediately for breach of these Terms. For refund policies on unused sessions following termination, please see Section 4.4.

9.4 Banned Users

We reserve the right to permanently ban users from our services for serious or repeated breaches of these Terms.

9.4.1 Definition of Banned User

A banned user is someone for whom we have terminated our services. The scope of a ban depends on who breaches these Terms:

• Student Breach: If a student breaches these Terms, only that individual student is banned
• Parent/Guardian Breach: If a parent or guardian breaches these Terms, only that individual parent/guardian is banned. Students may continue to use our services provided payment methods do not belong to the banned parent/guardian

9.4.2 Restrictions for Banned Users

Banned users are subject to the following restrictions:

• Banned users are permanently prohibited from booking any sessions
• No third party may book sessions on behalf of a banned user
• Attempts to circumvent bans through family members, friends, or alternative methods are prohibited
• We reserve the right to cancel any booking suspected to be for a banned user

9.4.3 Refund Policy for Banned Users

If a banned user or someone booking on their behalf attempts to book sessions, the refund terms outlined in Section 4.4 will apply.

9.4.4 Ban Appeals and Finality

All ban decisions are final and at our sole discretion. Banned users may request a review by contacting us, but we are under no obligation to reinstate banned users.

10. Complaints and Dispute Resolution

10.1 Complaint Process

If you have concerns about our services:

2. Provide specific details about the issue
3. We will investigate and respond within 5 business days
4. If unresolved, we will work toward a mutually acceptable solution

10.2 Governing Law

These Terms are governed by English law. Any disputes shall be subject to the exclusive jurisdiction of the English courts, unless you are a consumer entitled to bring proceedings in your local courts.

11. Modifications and Updates

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will:

• Post updated Terms on our website with a new effective date
• Notify existing clients of material changes via email
• Give reasonable notice before changes take effect

Continued use of our services after changes take effect constitutes acceptance of the new Terms.

13.1 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
